Welcome to Empire Porta. These Terms and Conditions (“Terms”) govern your use of empireporta.com (the “Site”) and the portable sanitation rental services we provide across New York, including standard porta potties, handicap-accessible units, deluxe flushable units, ADA-compliant units, flushable portable toilets, and VIP restroom trailers (“Services”).

By using our Site, requesting a quote, or renting equipment from Empire Porta (“Empire Porta,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to rent equipment or use our Services. By placing an order, you confirm that all information you provide is accurate and that you have the authority to book on behalf of yourself or your business.

2. Quotes, Bookings, and Payment

a) Quotes

All quotes provided by Empire Porta are estimates based on the information supplied at the time of request. Final pricing may vary based on unit type, quantity, rental duration, delivery location within New York, servicing frequency, and any additional requirements. Quotes are valid for the period stated on the quote document.

b) Bookings

A booking is confirmed only once Empire Porta acknowledges the order in writing (email or signed agreement) and any required deposit is received.

c) Payment Terms

  • Payment is due as stated on your invoice or rental agreement.
  • We accept major credit cards, ACH transfers, and other approved payment methods.
  • Late payments may incur interest charges and administrative fees, as permitted under New York law.
  • Empire Porta reserves the right to require prepayment or a deposit for large orders, events, or first-time customers.

d) Cancellations

Cancellations must be made at least 48 hours before the scheduled delivery date. Cancellations made after this window may be subject to a cancellation fee to cover dispatch, preparation, and scheduling costs.

3. Delivery, Placement, and Access

a) Delivery

Empire Porta will deliver units to the address provided at the time of booking. You are responsible for ensuring that the delivery location is accessible for our service trucks and that any required permissions, permits, or site access approvals are in place.

b) Placement

You are responsible for confirming the placement location. Once a unit is placed, moving it may require an additional service fee. Units must be placed on level ground with adequate clearance for servicing.

c) Failed Delivery

If our team is unable to complete a delivery due to blocked access, incorrect address, lack of permit, or the customer’s absence when access is required, a failed delivery fee may apply.

4. Customer Responsibilities

While a unit is in your possession, you agree to:

  • Use the unit only for its intended purpose (human waste disposal and handwashing where applicable).
  • Not tamper with, move, damage, vandalize, or modify the unit.
  • Not dispose of hazardous materials, chemicals, paint, oil, construction debris, or non-biodegradable items in the unit.
  • Ensure the unit remains accessible for scheduled servicing and pickup.
  • Notify Empire Porta immediately of any damage, tipping, vandalism, or unusual issues.
  • Comply with all applicable New York state and local laws, permits, and regulations related to portable sanitation on your site or event.

5. Damage, Loss, and Additional Fees

a) Damage to Units

Customers are responsible for any damage to Empire Porta equipment beyond normal wear and tear, including tipping, vandalism, theft, fire, or misuse. Repair or replacement costs will be billed at fair market value.

b) Additional Fees

Additional fees may apply for:

  • Extended rental periods beyond the agreed term
  • Additional servicing beyond the scheduled frequency
  • Emergency or same-day delivery
  • Relocation of units after placement
  • Improper disposal of prohibited items
  • Blocked access or failed pickup attempts
  • Lost, stolen, or unreturned equipment

6. Servicing and Maintenance

Empire Porta will service units according to the frequency stated in your rental agreement. Standard rentals include weekly cleaning; high-volume events, festivals, or long-term construction sites may require more frequent servicing. Customers may request additional service visits, subject to availability and additional charges.

If you are not satisfied with the cleanliness of a unit at any point during your rental, contact us and we will address it promptly.

7. Pickup and Return

Pickup will be scheduled at the end of the rental period as agreed. It is the customer’s responsibility to ensure the unit is accessible and ready for pickup on the scheduled date. Failure to make the unit available may result in continued daily rental charges until pickup is completed.

8. Site Conditions and Liability

The Customer is responsible for ensuring that the delivery site is safe, level, and suitable for the placement of a portable restroom unit. Empire Porta is not liable for:

  • Damage to lawns, driveways, pavement, curbs, or landscaping caused by delivery or pickup vehicles when accessing the placement location as directed by the customer
  • Damage caused by weather events, natural disasters, vandalism by third parties, or acts beyond our reasonable control
  • Injuries or damages arising from misuse, unauthorized modification, or improper access to the unit

The Customer agrees to indemnify and hold Empire Porta harmless from claims arising out of the Customer’s use, placement, or handling of the rented equipment.

9. ADA Compliance

Empire Porta provides ADA-compliant units designed to meet federal accessibility standards. However, the ultimate responsibility for ensuring adequate ADA compliance at your event, job site, or venue rests with the Customer or event organizer. We are happy to provide free consultation on quantities and placement.

10. Limitation of Liability

To the maximum extent permitted by law, Empire Porta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruption, or reputational harm, arising out of or related to the Services or use of our Site.

Empire Porta’s total liability for any claim arising from the Services shall not exceed the total amount paid by the Customer for the specific rental giving rise to the claim.

11. Force Majeure

Empire Porta shall not be held responsible for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, road closures, government orders, labor strikes, supply chain disruptions, pandemics, or acts of terrorism.

12. Intellectual Property

All content on empireporta.com โ€” including text, images, graphics, logos, videos, and design elements โ€” is the property of Empire Porta or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or use any Site content for commercial purposes without prior written permission from Empire Porta.

13. Website Use

By using empireporta.com, you agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Introduce viruses, malware, or other harmful code
  • Scrape, copy, or misuse Site content for competitive or unauthorized purposes

We reserve the right to restrict or terminate Site access for users who violate these Terms.

14. Third-Party Links

Our Site may contain links to external websites for reference or convenience. Empire Porta is not responsible for the content, policies, or practices of third-party sites.

15. Modifications to These Terms

Empire Porta reserves the right to update or modify these Terms at any time. Changes take effect when posted on this page. Continued use of our Site or Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or our Services shall be resolved exclusively in the state or federal courts located in New York.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy and any signed rental agreement or invoice, constitute the entire agreement between you and Empire Porta regarding your use of our Site and Services.
